1. Online sales contract
By online sales contract we mean the contract which has as its object the remote purchase of products and/or services on the site www.topitaly.org by a customer using any device (PC, notebook, tablet, smartphone, etc.) connected to the internet.
The seller of the products and/or services is TOP ITALY .
The commercial relationships between TOP ITALY and customers are governed by the following general conditions of sale. These conditions can be changed by the seller, but any changes will be effective only when they are published on the website www.topitaly.org and will refer to sales made from that moment on.
2. Conclusion of the contract
Acceptance of the sales proposal presented by TOP ITALY is carried out by correctly filling out the order form and consent to the purchase expressed through the registration given online.
The customer who sends the order will receive, via electronic mail (e-mail), at the end of the procedure, a message confirming receipt of the order.
With this confirmation, the contract is considered perfected, but its effectiveness is conditional upon payment of the goods. The payment conditions are reported in point 4 of these General Conditions of Sale.
3. Sales prices
The images are intended as indicative, as the product may present variations from an aesthetic point of view.
All sales prices entered on the site www.topitaly.org represent an offer to the public pursuant to art. 1336 cc and are understood VAT included .
Shipping costs are the responsibility of the customer , calculated based on the value of the goods purchased and will be displayed at the time of purchase and before proceeding to the checkout. Shipping costs vary based on the destination and value of the order as described in the appropriate area of the site. (link to shipping costs).
We specify that the collection of the ordered goods depends exclusively on the customer's will. Under no circumstances should it be refused, under penalty of being charged for round-trip transport costs. If the customer does not provide compensation for the transport cost within 15 days (notified via email) , Top Italy srls will begin legal proceedings to the detriment of the customer.
4. Payment methods
Payment for the products and/or services purchased and the related shipping costs must be made by the customer in the following ways: CREDIT CARD, PAYPAL or BANK TRANSFER . Detailed information Payments .
5. Execution of the contract - delivery
The order will be processed immediately and the products delivered within a minimum of 24/48 hours and a maximum of 7 working days. The said deadline starts from the day of the bank notification of the payment. In any case, delivery cannot exceed 30 days from the date of the order (ex art. 6 Legislative Decree 185/1999). Delivery will be made throughout Italy via national couriers and shippers trusted by the recipient. If the recipient is absent at the time of delivery, a notice will be left and the customer must personally contact the courier or forwarder as soon as possible to agree on the delivery methods; any costs for the temporary storage of the goods with the carrier will be borne by the customer. In any case, no responsibility can be attributed to the supplier for delayed or failed delivery attributable to force majeure or unforeseeable circumstances. A copy of the invoice will be sent via e-mail together with the shipment of the product. At the time of delivery, the customer must verify the integrity of the goods and their correspondence to the consignment note, both in terms of quantity and quality. In case of discrepancies, the customer must refuse the goods and contest the difference from the consignment note directly to the carrier. If the customer signs the delivery note, the goods will be considered accepted without reservations.
6. Delivery delay
It is possible that the package may not arrive within the times established or proposed on the website www.topitaly.org . In this case, the customer can contact the customer service of TOP ITALY to locate the package. For the to contact customer service use the appropriate area on the site.
TOP ITALY is not responsible for any damage or loss, direct or indirect, resulting from delayed or non-delivery of the product.
7. Returns
The following provisions regarding returns will be applied in two different cases:
1. In case of error of TOP ITALY when placing an order, shipping or delivery.
2. In case the ordered product arrives broken.
Any complaints can only be accepted if notified by e-mail within 5 working days from the date of receipt of the products, after this period any right to complaint lapses. The general conditions of acceptance of returns are described on the appropriate page.
8. Buyer's obligations
The customer undertakes and obliges, once the online purchase procedure has been completed, to print and keep these general conditions of sale which, moreover, he will have already viewed and accepted as an obligatory step in the purchase, as well as the specific of the product purchased, and this in order to satisfy the condition set out in the art. 3 and 4 of Legislative Decree 185/1999.
The buyer is prohibited from entering false data, in whole or in part, in the registration procedure necessary to activate the process for the execution of the contract and the related further communications. The personal data and e-mail must therefore be your real personal data and not those of third parties and/or fictitious.
9. Privacy
Pursuant to Law 675/96, the Customer also declares to know that the data provided are inserted into the "TOP ITALY Customer Data Bank" and can be used for promotional, commercial and sales purposes as well as for statistics through consultation, processing or comparison or for sending editorial and/or promotional material.
It is specified that the information and personal data acquired only for the aforementioned purposes will be treated in a strictly confidential manner and in any case in compliance with current legislation on privacy. We also remind you that the personal data will not be distributed and/or disseminated and/or or transferred to third parties and/or otherwise marketed.
